In, Human Rights in Our Time (HROT) anthropologist, human rights lawyer and professor Paul J Magnarella, gives us an accessible, briefcase ready, state of human rights law as it is now. I have not taught this subject for some time now but I wish I'd had this book then. As a teacher myself, I would have enjoyed access to the tight, well written sections covering just about everything imaginable in human rights while remaining under 300 pages. If I were teaching undergraduates, as I did my last time around, this would be my only required text. As laid out, the book provides ready made topics for class discussion as well as potential paper topics. But what if you are not a teacher?Quite frankly, most readers probably won't be teachers. That said, I would still recommend the book as the perfect introduction to the fairly complex field of human rights. In the United States we often hear the term human rights in the context of "other places." Meaning any where in the world but here. The most common phrase in the U.S. lexicon is "civil rights." I would classify civil rights as a subset of human rights and define them as the rights provided to citizens vis a vis their own country. As a retired law enforcement officer this was what I was taught all those years ago. Human rights are however, both much more and less, depending on the context. Without question, in a conceptual sense, human rights are much more than civil rights. Human rights cover everyone, everywhere, all the time and implies universality. But in specific contexts, human rights can be much less. Let me explain. We might all agree on the human right of access to clean water. This right was recently the subject of a U.N. resolution. But try enforcing that right against a repressive regime or where there is no water. This example is an oversimplification of course but it illustrates the point. We may all have many human rights but may not be able to make a positive legal claim to enforce those rights. Of course, the same may be said of civil rights in a particular national context. All of this and much much more is covered in HROT.
HROT give concise coverage to all the principle areas required for a good understanding of human rights. The book covers the United Nations, the primary international conventions, the international criminal tribunals, differences between the U.S., Europe, and other parts of the world and much more. HROT briefs the reader on the rights of the child and the rights of women in the international context. HROT also briefs the reader on issues concerning genocide and international humanitarian law (also called the law of war). HROT also discusses the use of torture and in an equally timely manner also takes a look at the killing of Osama bin Laden. HROT looks back over several hundred years in the development of human rights law but doesn't miss too many opportunities to present issues that seem torn from current headlines. I highly recommend this book.
